1. WARRANTY AND METHOD OF ASSISTANCE
The products sold are covered by the manufacturer’s conventional guarantee and, for final consumers only, by the legal guarantee of 24 months for lack of conformity, pursuant to art. 128 ff. Legislative Decree no. 206/2005.
The manufacturer’s conventional warranty is provided in the manner illustrated by the manufacturer himself. The 24-month warranty applies to products that show a lack of conformity, provided that the product is used correctly and in compliance with its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private consumer. In the event of a lack of conformity, the seller will restore the conformity of the product by repairing / replacing or reducing the price, until the contract is terminated. If, following intervention by an Authorized Service Center, the defect does not result in a lack of conformity, the Customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as transport costs if incurred by the seller. .
The timing of replacement or repair of the product depends exclusively on the manufacturer’s policies. In the event that, for any reason, it is not able to return a product under warranty (restored or replaced) to its customer, the seller may proceed at its discretion to return the entire amount paid or to replace it with a product of characteristics equal or higher.
In all cases where the application of the guarantees provides for the return of the product (repair or replacement), the goods must be returned by the Customer in the original packaging, complete in all its parts (including internal and external packaging and any documentation and equipment accessories: manuals, cables, batteries, etc …). Polarice Service therefore reserves the right not to accept products shipped by the customer without these characteristics and to return them at the expense of the customer. Before sending the product, the Customer must ask Polarice Service for the authorization number to return the product by filling in the appropriate online returns request form. In case of authorization to return, the shipment of the defective goods will be charged to the Customer, while the return of the repaired or replaced goods will be the responsibility of Polarice Service. In the event that the goods returned under warranty are perfectly functional, Polarice Service will return the same at the expense of the Customer. If the repair of the product is not covered by the warranty, Polarice Service will notify the Customer of the amount of the estimate. In the event that the Customer renounces the repair, he will be charged the minimum flat-rate cost of € 35.00 required by the assistance center for product control.
The warranty only covers the repair or replacement of unusable or inefficient items due to manufacturing or production defects found in the service center authorized by the manufacturer. The warranty does not cover parts subject to wear. Polarice Service will never, under any circumstances, be burdened with charges or damages deriving from any interruptions in the operation of the devices subject to the guarantee. Defective equipment must be sent, subject to the authorization of Polarice Service, with the guarantee certificate or a document proving the purchase attached, to the following address: Polarice Service s.a.s. – Via Cirino Paone, 34/36 – 96016 Lentini (SR).
The repair times of the official assistance centers of most of the manufacturers are around 45 days. Polarice Service will never, under any circumstances, be burdened with charges or damages deriving from any delays in repair due to third parties.

2. RIGHT OF WITHDRAWAL
Based on the legislative decree Legislative Decree 185/1999, Legislative Decree 206/2005, Legislative Decree 21/2014, the buyer’s right of withdrawal is normalized if the signing of a sales contract occurs not in commercial premises but through the so-called distance selling (by mail order or via the internet).
Therefore, all natural persons who have purchased through our website www.polariceservice.com have the right to withdraw, this right can be exercised without giving any reasons, this right is not granted to legal persons (companies or companies) and to natural persons who they purchase for their own commercial activity, i.e. those who place an order indicating the VAT number for the invoice. IMPORTANT: The right of withdrawal applies to the product purchased in its entirety, therefore the same must be intact and returned in the original packaging, complete with all its parts including any instructions for use and, in case of seals on the package, without these having been removed. Shipments until arrival at our warehouse are under the full responsibility of the Customer. In case of damage to the product during transport it will be ns. take care to communicate it to the Customer. The Polarice Service company is not responsible in any way for damage or theft or loss of goods traveling with uninsured shipments. Once it arrives in the warehouse it will be our care is taken to examine the product to ensure that there is no tampering or damage, if the original packaging or packaging is damaged, in this case the Polarice Service company will deduct a percentage of 15% of the value of the product from the reimbursement as a contribution to expenses. 3. RESPONSIBILITY

4. BUYER’S OBLIGATIONS

5. FAILURE TO DELIVER THE GOODS
If it was not possible to deliver the goods to the address provided by the Customer when ordering for reasons beyond our control (such as: absent recipient, incorrect address provided by the Customer, refusal of the goods without reason), the The goods will be returned to the Customer only after payment of the costs relating to the return of the goods burdened by the costs of any storage at the couriers’ warehouses and burdened by the costs of logistics management. 6. WITHDRAWAL OF THE SUPPLIER

7. SHIPPING
Shipments are made through national express couriers of proven reliability. It is not possible in any way for the Customer to indicate a preferred courier or to indicate times or time slots for delivery or to ask to be notified before delivering. With regard to these cases, if the Customer fails to guarantee his presence on the occasion of the delivery, we strongly recommend providing an alternative address of convenience where his presence is ensured (example: family member, company, shop, etc.) in order not to incur problems set out in Point 5 of this contract (FAILURE TO DELIVER GOODS). 8. PRODUCTS IN SPECIAL OFFER
Payment for any purchases of promotional products for a certain period must be paid within the promotion period. 11. REFUND OF PAYMENTS MADE WITH POSTEPAY PAYMENTS
In case of total or partial reimbursement for reasons beyond our control (therefore at the request of the Customer who, for example, intends to cancel the order), the sum of Euro 2.00 equal to the requested commission will be deducted from payments made via PostePay recharge. from the Lottomatica bookshops, and in any case not less than the commission costs in effect at the time of reimbursement.

12. JURISDICTION AND COMPETENT COURT

Any dispute relating to the application, execution, interpretation and violation of online or fax sales agreements obtained through the website www.polariceservice.com is subject to Italian jurisdiction; these general conditions are reported, although not expressly provided therein, in conjunction with Legislative Decree 50/92 and Legislative Decree 206/05.
For any dispute between the parties regarding this contract, it will be the exclusive competence of the Court of Syracuse.
